The following terms and conditions apply in general. When starting to work on a one-to-one or group basis, additional elements may be agreed upon to ensure a safe and reflective space is created for all participants. Rather than engaging in legal jargan, Stephen has tried to keep these terms and conditions as clear as possible.

Contracting Entity

Bysands Limited provides any services purchased through this website. Stephen, and his wife Sinéad are the company directors of Bysands Limited. The company is registered in Ireland, registration number 459464. It is VAT-registered and trades not only as Bysands Limited but also Invoking Curiosity and Reflective Coach. These are other websites which offers services provided by Stephen.

The registered address for Bysands Limited is 17 Elmbrook Lawn, Lucan, County Dublin, Ireland, K78 PH32.

Bysands Limited will be the entity issuing invoices and stated on any online payments.

What is Coaching

Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Coachee in a thought-provoking and creative process that inspires the client to maximize personal and professional potential.  It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

The coachee is responsible for determining what is the key area of focus for any given coaching session and the coach will work to that agenda.  If the agenda starts to move away from the outcomes that the coachee has identified in this document, the coach will bring the coachee’s attention to this, and ultimately it is for the coachee to determine the focus. 

Ethics

Stephen is a member of the International Coach Federation (ICF) and as such, adheres to the ICF Code of Ethics, a copy of which can be found via this link.   The Coach’s ICF membership can be validated using the coach directory on the ICF website using this link.  Stephen also holds a Professional Certified Coach (PCC) level credential with the ICF and this credential can be verified by Credly using this link.

Confidentiality

We will always treat your information confidentially and in compliance with any relevant legal obligations. We never sell your personal data to any third party for marketing purposes. We try to minimise the amount of third party services we utilise to provide any of our services.

Any information revealed during coaching will be confidential.  However, there are some limitations to this confidentiality.  Specifically, if you inform Stephen that you’re going to do harm to yourself, others or commit a crime or in situations where Stephen has a legal obligation to break confidentiality. As a professional coach, Stephen also attends coach supervision.  Should he bring to supervision anything from coaching sessions, he’ll do so in a way which doesn’t go into specifics about coachee’s identify.   Rather, it will be focused on how Stephen is ‘being’ a coach and working with his caochees.

Limitations

The Coachee is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Stephen. As such, the Coachee agrees that Stephen and Bysands Limited is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by Stephen. The Coachee understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

The Coachee acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Coachee agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Coachee’s responsibility.

The Coachee acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or  other professional advice by legal, medical or other qualified professionals and that it is the Coachee’s exclusive responsibility to seek such independent professional guidance as needed. If the Coachee is currently under the care of a mental health professional, it is recommended that the Coachee promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Coachee and Stephen.

GDPR & Releasing of personal details

Stephen will only keep the following information:   

  • Details required to invoice your for any agreed services (if applicable)
  • Contact details primarily related to the provision of agreed services for purposes such as arranging, scheduling, and confirming sessions
  • Any coaching agreements created as part of the services being offered (which will be kept for a period of seven years)

You also agree that the Stephen may record the following information in his coaching log:  Your name, contact details (Phone and/or email), the start date of coaching, the end date of coaching and the number of hours of coaching delivered.  No other details around the content of the coaching sessions is recorded in this log.  The purpose and use of this log is in connection with the credentialing process with the ICF and Stephen’s continued professional development as a coach.  This coaching log may also be audited at a future date by the International Coach Federation and they may contact you to confirm coaching took place as recorded.

Any other information you provide will only be used for the provision of the service or request for which you have provided the data. Depending on your location, you will have certain rights to ask for this information to be updated, amended or deleted and we will always make a good-faith effort to comply with all requests.

Refund & Cancellation Policy

Generally, if you cancel a purchased service before consuming any part of the service, we will endeavour to provide a full refund. However, once an appointment has been scheduled or the service delivery has commenced, a full refund will no longer be possible.

  • Cancellation of scheduled coaching sessions: If a coachee cancels a coaching session (as part of a programme of coaching) with less than 24 hours’ notice, the coachee will be charged full price for the coaching session, and no refund will be possible. If the session is cancelled with more than 24 hours’ notice, it may simply be rescheduled for a future date.
  • One-off coaching sessions: You are entitled to a full refund provided you have not scheduled your one-to-one session with Stephen. Once the session has been scheduled, you will not be entitled to a refund however you will be entitled to reschedule the session, providing you give more than 48 hours’ notice via the online scheduling tool or email.

Money Back Guarantee

The money-back-guarantee is only applicable for those engaging in a programme of coaching (Minimum of 4 coaching sessions over a period of time). If, after your first coaching session, you are not entirely satisfied, you may request a full refund in writing via email to Stephen. This guarantee does not apply to any other services offered.

Honesty

Complete honesty is important during any work that we engage in together.   If the coachee deosn’t feel something is working for them or they’re not getting what they feel they need from this coaching partnership, they should let the Stephen know so that he can discuss and adjust course as necessary.

Testimonial and Recommendations

At the end of any services we provide, we will send you a short feedback survey. We would very much appreciate any feedback you feel you are willing to provide. We would also ask that if you found the work useful and valuable, that you consider writing a testimonial and recommending him to a colleague or friend who may also benefit from a similar engagement.

Insurance & Invoicing

Invoices will be issued from Bysands Ltd. and, where applicable, include Irish VAT at the standard rate. All coaching is covered by professional indemnity insurance and a copy of the insurance details can be provided upon request
